1) Overview

Welcome to Amryth (“Amryth,” “we,” “us,” “our”). We operate this website and online store, including all related information, content, features, tools, products, and services (collectively, the “Services”) to provide you with a curated shopping experience.

Our store is hosted on Shopify Inc. (“Shopify”), which provides the e-commerce platform that allows us to offer the Services.

These Terms of Service (“Terms”) govern your access to and use of the Services, including browsing the site and purchasing products.

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2) Eligibility, Age Restrictions & Intended Use (21+)

The Services and products are intended for adults aged 21+.

By using the Services or placing an order, you represent and warrant that:

  • You are at least 21 years old (or the age of majority in your jurisdiction, whichever is higher), and

  • You will not purchase, provide, or make products available to anyone under 21.

We may use age-gating or other verification methods. If we suspect an order is placed for or by a minor, we may cancel it at our discretion.

3) Health & Safety Disclaimer

Our products are not intended to diagnose, treat, cure, or prevent any disease. Statements made regarding our products have not been evaluated by the Food and Drug Administration (FDA). Individual experiences may vary.

Use responsibly. Sensitivity differs by person. You assume full responsibility for determining whether any product is appropriate for you, including considering your health status, medications, and personal tolerance.

Consumption guidance: We do not recommend more than two (2) drinks within a 24-hour period.

If you feel unwell after consuming the product, discontinue use and seek medical advice if needed.

4) Access, Accounts & Accuracy of Information

You may be asked to provide information such as your email, billing, payment, and shipping details. You agree that all information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may not transfer, sell, assign, or license your account to another person.

5) Products & Product Information

We make reasonable efforts to display products accurately. However:

  • Product colors and appearance may vary based on device and screen settings.

  • Product descriptions and pricing may change at any time without notice.

  • We reserve the right to modify or discontinue any product at any time.

We may limit quantities offered per person, household, or order.

6) Orders, Acceptance & Cancellations

When you place an order, you are making an offer to purchase. We may accept or decline orders at our discretion, including for suspected fraud, errors, or compliance reasons.

Your order is not considered accepted until we confirm it and process payment.

Please review your order carefully before submitting it. Once an order is accepted, we may be unable to cancel or modify it.

7) Pricing, Promotions, Taxes & Billing

Prices, discounts, and promotions may change without notice. Unless stated otherwise, prices do not include taxes, shipping, handling, or other charges.

You agree to provide valid payment information and authorize us (and our payment processors) to charge the full amount, including applicable taxes and shipping.

Prices on our website may differ from pricing in retail stores or third-party marketplaces.

8) Shipping & Delivery

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs, or events outside our control.

Risk of loss and title pass to you once the order is transferred to the carrier, to the extent permitted by law.

9) Refunds, Returns & Exchanges

Due to the nature of our products and fulfillment process, we do not offer refunds, returns, or exchanges for any orders that have already shipped. Once an order leaves our facility, it is considered final.

If you experience an issue (such as receiving the wrong item or a damaged product), please contact us within 48 hours of delivery with:

  • Your order number, and

  • Supporting photos (and/or video if helpful)

We will review the issue and determine an appropriate resolution at our discretion.

This policy is incorporated into these Terms by reference and may also appear on our Refund & Return Policy page.

10) Subscriptions, Pre-Orders, and “Try Before You Buy” (If Offered)

Certain items may be offered as subscriptions or pre-orders.

Subscriptions

If you purchase a subscription, you will receive repeat deliveries based on the frequency selected. Your payment method will be stored securely and charged for each delivery unless you prepay or cancel.

You can manage or cancel a subscription using the links in your order confirmation emails or via your account (if available).

Pre-Orders

If you purchase a pre-order, you are purchasing an item that may not yet be available for immediate fulfillment. We may charge your payment method at checkout or later when the product is ready to ship.

Try Before You Buy

If offered, we may authorize your payment method before fulfilling the order. If you do not return the item within the specified period, your payment method will be charged.

Refunds and returns for these purchases are governed by our Refund & Return Policy.

11) Intellectual Property

All content and materials on the Services—including text, graphics, logos, images, videos, product names, and design—are owned by Amryth or licensed to us and are protected by intellectual property laws.

14) User Content & Feedback

If you submit reviews, comments, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, publish, and display that Feedback for any purpose, including marketing.

You represent that your Feedback:

  • Does not violate any laws or third-party rights

  • Is not fraudulent, misleading, or harmful

  • Does not contain malware or malicious code

We may remove Feedback at our discretion.

15) Prohibited Uses

You agree not to use the Services:

You agree to indemnify and hold harmless Amryth, Shopify, and our affiliates, employees, and service providers from any claim arising out of your breach of these Terms, violation of law, or misuse of the Services.

19) Termination

We may terminate or suspend your access to the Services at any time, without notice, for any reason. Provisions that by their nature should survive termination will survive.

20) Governing Law

These Terms and any disputes arising from them are governed by the laws of the state where Amryth is headquartered, without regard to conflict of law principles.

You consent to personal jurisdiction and venue in the applicable state and federal courts.

21) Changes to These Terms

We may update these Terms at any time. The “Last Updated” date will reflect changes. Your continued use of the Services after changes become effective constitutes acceptance.
